This is especially important when a participant tries to rely on Australian consumer legislation to address poor performance. This is another complex and widely misunderstood area. In most cases, a service agreement should be reached between the participant and the service provider in a format that the participant will most likely understand. However, there are a number of variables, including the content of the service agreement and all alternative decision makers who are appointed (and for whom this is important). Thus, they can sign a service contract, but the takeover is concerned with whether the candidate`s authority extends to conditions that are personal to the participant and that the participant controls alone.  Damages and interests and liability – liability clauses for property such as property damage and behaviour of concern (including loss and personal injury). These terms have been identified in agreements made by organizations specifically funded to help people with complex behaviours. Our support coordination workshops are often dominated by discussions about what should be included in an NDIS service agreement, which must have one and who must sign one. Many service agreements are unnecessarily complicated, but when we talk about simplification with suppliers, there are reservations for fear of non-compliance. But in a system based on choice, control and presumption of capacity, perhaps the opposite could happen. Most services offered by NDIS providers are GST-free.
